Terms & Conditions for Events and Workshops - Delegates
1.1 What these terms cover. These terms and conditions (the “Terms”) apply between the person, firm, company or other entity specified on your booking form (”you” or “your”) and SE1 Media Limited (trading as “Digital Tourism Think Tank”) a company incorporated in England with registered number 05732153 whose registered office is at 77 Stour Street, Canterbury, Kent, England CT1 2NR, with VAT number: GB 888696825 (“DTTT”, or “we”, “us” and “our”) for delegate registrations for the event (including but not limited to conferences, seminars, workshops and networking events) specified on your booking form (the ”Event”). Please read them carefully as they contain important information.
1.2 Event Registration. By submitting your registration to attend the Event (the ”Registration”) you agree to be bound by these terms to the exclusion of all other terms. If you do not agree to be bound by these terms DTTT will be unable to accept your registration, and you will be unable to attend the Event.
1.3 How to contact us. You can contact us by writing to us at firstname.lastname@example.org.
1.4 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
1.5 Do you need extra help? If you would like this contract in another format (for example: audio, large print, braille) please contact us using the contact details above.
2. Event Registration and Payment
2.1 Registration. Your registration for the Event is an offer to DTTT to attend an Event which is subject to DTTT’s acceptance in writing (which may include (without limitation) email). A binding contract between DTTT and you will only be formed when written confirmation of acceptance (the ”Confirmation” or “Confirmed”) is sent by DTTT to you (whether or not it is received) using the contact details you provided at the time of registration after your Fee (as defined below) for the Event has been received in full and in cleared funds by DTTT.
2.2. Information you supply must be accurate and complete. When you register with us, you agree that you will at all times provide us with true, accurate, current and complete personal information.
2.3. Prices. Total prices for an Event are displayed on the order page of our website (inclusive of any applicable taxes), and are correct as at the time of Registration (the “Fee”). DTTT reserves the right to change the prices for an Event at any time, but changes will not affect Registrations which have already been confirmed by DTTT. The Fee shall be payable in the currency specified on our website.
2.4. Payment. We accept payment with Stripe (the “Payment Providers”), and also directly from you via credit card and bank transfer in circumstances where we issue an invoice to you (an “Invoice”). You must pay when submitting your Registration (or, in the case of a Fee contained in an Invoice, that Fee must be paid by you within 14 working days of the date of the Invoice).
2.5. Confirmation. You should receive Confirmation of your Registration by email shortly after submitting your Registration and making your payment to us. Please contact DTTT if you have not received Confirmation within 5 days of your Registration or making your payment, whichever is later.
2.6. Tickets. You will receive your ticket(s) by email shortly after you receive your Confirmation to the Event (the “Ticket”). Tickets are non-refundable (subject to paragraphs 8 and 3.3 below), and cannot be resold, coupled or bundled with any other product or services, or used for any commercial or promotional purposes whatsoever. If a Ticket is resold or otherwise used in breach of these Terms, then the bearer of the Ticket or the person claiming the right to attend the Event will be refused admission to the Event.
2.7. Substitution. Substitutions with employees from your organisation are welcome at any time but in all other respects delegate Registrations are issued for your personal use only and cannot be shared with, or transferred to, any other person. You must notify us of any such substitutions in advance of an Event.
2.8. No automatic right to cancel. Tickets are non-refundable. However, notwithstanding this, if you are no longer able to attend an Event or if you have changed your mind, then you can contact us in writing to make a refund request (a “Refund Request”). We may at our absolute discretion give you a refund following receipt of a Refund Request from you.
3.1. Attendance. Receipt of your Confirmation gives you the right to attend the Event to which your Confirmation relates.
3.2. DTTT reserves the right to change Events. DTTT reserves the right (at its absolute discretion) to change the format, speakers, participants, content, venue location and programme or any other aspect of any Event at any time and for any reason, and without advance notice, and in each case without liability. We will try and give you advance notice of any such changes, but giving you advance notice will not always be possible.
3.3. Changes to Event dates and/or cancellation of Events. DTTT may (at its absolute discretion) change the date or cancel an Event at any time for any reason. Where DTTT changes the date of an Event or cancels the Event for any reason DTTT shall offer you the option of attending any re-arranged Event that DTTT chooses to organise (at its absolute discretion) in place of the original Event. If you promptly notify DTTT in writing before the date of the Event that you do not wish to attend the rearranged Event or if DTTT elects not to rearrange the Event then you will (as your sole remedy) be entitled, at your discretion, to receive either a credit note or a refund in respect of your Fee received by DTTT.
3.4. Venue. By attending an Event, you agree to be bound by any and all terms and conditions, rules and regulations of any venue where an Event is held (a “Venue”) (the “Venue Terms”). DTTT reserves the right (at its absolute discretion) to refuse admission to, or eject from the Event, any person including (without limitation) any person who fails to comply with these Terms or who in the opinion of DTTT represents a security risk, nuisance or annoyance to the running of the Event. You agree to comply with all reasonable instructions issued by DTTT or the owners of the Venue at an Event.
3.5. Use of photographic and/or recording equipment is prohibited. You may not use any personal photographic and/or recording equipment at any Event, or in any Venue, without DTTT’s prior written consent.
3.6. Filming and sound recording of you. When attending an Event filming, sound recording and photography may take place. Upon arrival at an Event, we ask all delegates to consent to such filming and sound recording and photography of the Event, and also to the use by DTTT of any such recording or photography anywhere in the world for promotional, marketing and other purposes, by signing a consent and waiver form.
4.1. Our liability: changes to Events. Subject to paragraph 5 below, to the fullest extent permitted by applicable law, DTTT shall not be liable to you for any loss, delay, damage or other liability incurred resulting from or arising in connection with the cancellation or date change of the Event howsoever arising or any venue change. You acknowledge and agree that the provisions of paragraph 3.3 sets out your sole remedy should the Event date be changed or cancelled and all other liability of DTTT is expressly excluded.
4.2. Our liability: limitations and exclusions. Subject to paragraph 4.5 below, to the fullest extent permitted by applicable law, DTTT excludes:
- all liability for loss, injury or damage to persons or property at the Event;
- all indemnities, warranties, representations, terms and conditions (whether express or implied); and
- any actual or alleged indirect loss or consequential loss howsoever arising suffered by you or any loss of profits, anticipated profits, savings, loss of business revenue, loss of business, loss of opportunity, loss of goodwill, or any other type of economic loss (whether direct or indirect).
4.3. Our liability is capped. Subject to paragraph 5 below, if DTTT is liable to you for any reason, DTTT’s total liability to you in relation to an Event (whether under these terms or conditions or otherwise) is limited to the amount of your Fee received by DTTT.
4.4. Events beyond our control. If, by reason of any event beyond our reasonable control (including but not limited to speaker or participant cancellation or withdrawal, supplier or contractor failure, venue damage or cancellation, health scares, industrial dispute, governmental regulations or action, military action, fire, flood, disaster, civil riot, acts of terrorism or war) (“Force Majeure Event”), DTTT is delayed in or prevented from performing any of its obligations under these Terms, then such delay or non-performance shall not be deemed to be a breach of these Terms and no loss or damage shall be claimed by you by reason thereof. DTTT’s obligations shall be suspended during the period of the delay or non-performance and DTTT and you shall each use reasonable endeavours to mitigate the effect of the Force Majeure Event
4.5 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; and for fraud or fraudulent misrepresentation.
5. Intellectual property rights.
All intellectual property rights in the Event (and any content therein, including but not limited to within presentations and speeches etc.) (“Content”) throughout the world belong to us, our affiliates, or third parties. All right, title and interest in and to the Content shall remain our property and/or the property of such other affiliates and third parties.
6. Data protection
6.2. Information we hold about you. At any time you may ask us to send you a copy of your information from our records, remove your information from our records or correct or update your information.
7. Other important terms
7.1. Changes to these Terms. DTTT reserves the right to amend these terms and conditions from time to time at its absolute discretion. However, you will be subject to the terms and conditions in force at the time you submit your registration.
7.2. We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms to another organisation.
7.3. You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
7.4. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
7.5. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
7.6. Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of these terms in the English courts.
